Terms and Conditions
Welcome to theoceanguide.com. By accessing and using this website, you agree to comply with and be bound by the following Terms and Conditions. If you do not agree with any part of these terms, please do not use our website.
1. Nature of the Website
theoceanguide.com is a personal, independent educational project created by two enthusiasts in Spain. The website provides information regarding marine species sightings, locations, and frequencies for informational and entertainment purposes only. We may change, suspend or discontinue the website, or any part of it, at any time, and we do not guarantee that it will always be available or free of errors. We may also update these Terms from time to time; the date at the top shows the latest version, and by continuing to use the site after a change you accept the updated Terms.
2. No Warranty and Disclaimer of Liability
Accuracy of Data: Marine ecosystems are dynamic and unpredictable. While we try to provide helpful information, we do not guarantee that the data, locations, or frequencies of species sightings are 100% accurate, complete, or up-to-date.
Assumption of Risk: Any activities you undertake based on the information found on this website (such as diving, traveling, boat trips, or swimming) are done entirely at your own risk. Water temperature, visibility, current strength and the best months to visit are estimated averages, not live or guaranteed conditions. They do not replace proper training and certification, the advice of local dive operators, or official warnings. Always check conditions locally, dive within your limits, and follow local rules for protected areas and wildlife.
Limitation of Liability: To the extent permitted by law, the creators of theoceanguide.com are not liable for any damages, losses, accidents or injuries resulting from the use or misuse of the information on this website. Nothing in these Terms limits any liability that cannot be limited by law.
3. Intellectual Property
All original content, text, graphics, data and logos on theoceanguide.com, including the way our information on destinations and marine life is compiled and organised, belong to the website creators unless stated otherwise. Photos belong to the authors credited on them. You may link to our pages and quote short extracts with a link back, but you may not copy, reproduce or distribute our content without our prior written consent. Automated extraction of our content or data (scraping) and using it to train AI models are not allowed without our permission.
4. Third-Party Links
Our website contains links to other websites, such as photographers' pages, map providers and social networks. We do not control those sites and are not responsible for their content, availability or privacy practices, and a link does not mean we endorse them. If you find a link to illegal or harmful content, write to us at support@theoceanguide.com and we will remove it promptly.
5. Acceptable Use
When using theoceanguide.com, you agree not to try to access accounts or areas you are not authorised to use, including the admin panel; not to interfere with the security or operation of the site or overload it with automated requests; and not to use the site for any unlawful purpose. We may block access for anyone who does.
6. Governing Law
These Terms are governed by the laws of Spain, and any disputes will be handled by the courts of Spain. This does not affect any mandatory rights you have as a consumer under the law of your country of residence, including the right to bring a claim there. If any part of these Terms is found to be invalid, the rest will remain in effect. These Terms are available in English and Spanish. If the two versions differ, the Spanish version prevails.
